Website Terms and Conditions of Use

These Terms and Conditions ("the Terms and Conditions") govern your ("the User") use of the RFID-Experts Africa (Pty) Ltd t.a. BringMeHome ("Provider") website located at the domain name www.petlookup.co.za ("the Website"). By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out in this document.

THE SERVICE

1. The Website is a pet identification information website, owned by RFID- Experts Africa (Pty) Ltd, created in order to :

1.1 allow pet owners to receive information (if available) as to the whereabouts of their missing pets ; and

1.2 allow persons who have found lost pets to, where possible, reunite them with their owners.

2. The Website allows a User to log into the site with the password given by BringMeHome Administration (“Administration”) to retrieve his Completed Microchip Certification, or to amend existing pet profiles through completing an online application form. The Website also allows a registered User, including a User who does not have a registered account, to obtain the e-mail address and pet details of a registered User that correspond to a 15 digit unique microchip number linked to the pet tag inserted in the pet in question.

3. No fees are charged for the service.

USE OF THE SERVICE

4. The User agrees, when using the Website and the services made available in the Website :

4.1 to only utilise same in a bona fide attempt to locate owners of missing pets ; and

4.2 that all and any information provided to the vet who completes the application form to open or update a registered account in your name and the Administration in order to update any information via an online application form will be accurate, true and correct.

GUARANTEES AND REPRESENTATIONS

5. The User acknowledges that the Provider does not and has not given or made any guarantees or representations of any kind regarding the accuracy, applicability or content of the information, services or tools provided on the Website.

LIMITATION OF LIABILITY

6. The User acknowledges and accepts that the use of the Website is at his own risk.

7. Although reasonable care has been taken to ensure that the Website is secure, the Provider cannot speak for its users. As such, the Provider will not be liable for any invalid or offending content.

8. The Website and all content on the Website are provided on an "as is" basis and may contain inaccuracies and/or typographical errors. The Provider makes no warranty or representation as to the availability, accuracy or completeness of the content of the information. Neither the Provider nor any holding company, affiliate or subsidiary of the Provider, shall be responsible for any direct or indirect special, consequential or other damage of any kind whatsoever suffered or incurred, related to the use of, or the inability to access or use the Website or any functionality thereof, or of any linked website or the content of the information contained therein.

USE OF PERSONAL DETAILS

9. The User acknowledges that he has read and understood the Privacy Statement of RFID-Experts Africa (Pty) Ltd t.a. BringMeHome.

10. The User agrees that his personal details (viz. his e-mail address) and details of his pet(s) may be disclosed to persons who access the Website and enter the 15 digit unique microchip number linked to a pet tag inserted in his pet.

JURISDICTION AND APPLICABLE LAW

11. Any claim that may arise in consequence of this Website shall be governed by the law of the Republic of South Africa.

12. The User hereby consents to the jurisdiction of the High Court of South Africa, Western Cape Division, Cape Town, for all purposes arising from or associated with the use of this Website.

DISPUTE RESOLUTION

13. The Provider shall be entitled, at its election, to refer any dispute arising from these terms and conditions or that is in any way related to the use of this Website, to arbitration. In this event :

13.1 the arbitration shall be held in Cape Town, South Africa ; and

13.2 the arbitrator shall be appointed by the Arbitration Foundation of Southern Africa and shall be a practising senior advocate with at least 10 years experience in practice ; and

13.3 the arbitration proceedings shall be conducted in accordance with the rules laid down by the Arbitration Foundation of Southern Africa.

14. The provisions of clause 13 shall not preclude any party from applying for interim or urgent relief to the High Court of South Africa, Western Cape Division, Cape Town.

UPDATING OF THESE TERMS AND CONDITIONS

15. The Provider reserves the right to change, modify, add or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the User's obligation to periodically check these Terms and Conditions at the Website for changes and updates. The User's continued use of this Website following the posting of changes or updates will be considered notice of the User's acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.

Introduction :

This notice explains how we obtain, use and disclose your personal information, as is required by the Protection of Personal Information Act ("PPI").

The information we collect :

We collect and process your personal information (which includes information pertaining to your pet(s) ) mainly to allow a third party who has found your missing pet to contact you (via e-mail), to notify you about site updates and to improve the content of the website.

The type of information we collect will depend on the purpose for which it is collected and used. We will only collect information that we need for that purpose.

We collect information directly from the vet who completed the application form to open or update a registered account in your name.

Website usage information is collected using "cookies" which allows us to collect standard internet visitor usage information. Cookies are text files placed on your computer to collect standard internet log information and visitor behaviour information. We will use your personal information only for the purposes for which it was collected or agreed with you, for example to allow a third party who has found your missing pet to contact you (via e-mail) or to allow you to receive information as to your lost pet's whereabouts (where available).

We disclose your personal information (your e-mail address and your pet’s details) to persons who access the Website and enter the 15 digit unique microchip number linked to a pet tag inserted in your pet. We have agreements in place to ensure that they comply with these privacy terms.

We may also disclose your information :

  • where we have a duty or a right to disclose in terms of law ;
  • where we believe it is necessary to protect our rights.

Information Security :

We are legally obliged to provide adequate protection for the personal information we hold and to stop unauthorised access and use of personal information. We will, on an ongoing basis, continue to review our security controls and related processes to ensure that your personal information is secure.

We may need to transfer your personal information to another country for processing or storage. We will ensure that anyone to whom we pass your personal information agrees to treat your information with the same level of protection as we are obliged to.
